สรรพากรจะรู้ได้อย่างไรว่าเรามีรายได้เท่าไหร่

แบ่งเป็น 2 กรณี

กรณีที่ 1. จดนิติบุคคล
ถ้าคุณเป็นนิติบุคคล บริษัท หรือห้างหุ้นส่วน #ถ้าอยู่ในจุดนี้ครูไม่ห่วงมากค่ะ เพราะบังคับให้ทุกองค์กรทำบัญชี เมื่อทำธุรกิจมีรายได้ ก็ต้องมีเอกสารทางบัญชีไม่ว่าจะ ใบเสร็จรับเงิน ใบส่งของออกโดยถูกต้องให้ตรงกับเงินทีาเข้าบัญชีบริษัท ยื่นภาษีมูลค้าเพิ่ม VAT แจ้งรายได้ทุกเดือน(กรณีจด vat) มีสำนักงานบัญชีที่ดูแล มีผู้ตรวจสอบบัญชีคอยตรวจ และยื่นงบการเงินให้สรรพากรทุกปี

#สรุป ถ้าจดนิติบุคคล กฏหมายสั่งให้ทำบัญชี บังคับทำก็ต้องทำให้ถูกต้อง ควรทำให้เป็นไปตามบัญชีชุดเดียว การจดนิติบุคคลถ้าทุนจดทะเบียนและชำระไม่เกิน 5 ล้าน รายได้ตลอดทั้งปีไม่เกิน 30 ล้าน ได้รับการยกเว้นภาษี จากกำไร 3 แสนแรก #โปรแรงได้ใจSMEจริงๆ

กรณีที่ 2 : ทำธุรกิจแบบเจ้าของคนเดียว
ทำในรูปแบบบุคคลธรรมดา ปกติกรมสรรพากรจะ #รู้รายได้ก็ต่อเมื่อเรายื่นแสดงรายได้เมื่อเสียภาษี โดยการคำนวณรายได้ของบุคคลจะยึดตามเกณฑ์เงินสด พิจารณาจากเงินสดที่ได้รับ ไม่บังคับให้จ้างสำนักงานบัญชีให้ทำบัญชีส่งทุกปี แต่ไม่ได้หมายความว่าเราไม่ต้องจดนะคะ ทำในรูปแบบของบุคคลก็ควรที่จะจดรับ-จ่าย เพื่อดูผลประกอบการในแต่ละเดือน

แต่ประเด็นอยู่ที่เจ้าของกิจการยื่นรายได้ต่ำกว่าความจริง หรือไม่ยื่นเลย ที่เขาเรียกกันว่า หลบรายได้นั้นแหละคะ

หลบรายได้=หลบภาษี

เมื่อเป็นเช่นนั้น ทางกรมจึงมีอีกระบบที่ไม่รอให้เจ้าของมาแจ้งรายได้แล้วเพราะเกรงว่าจะมีการหลบรายได้ #จึงมีระบบการตรวจสอบขึ้นมา ไม่ว่าจะเป็นธุรกิจบุคคลแบบมีหน้าร้าน หรือ แบบออนไลน์

ธุรกจแบบมีหน้าร้าน ทางกรมฯก็จะใช้วิธีการเข้าไปพบ พูดคุย ซักถาม และสังเกตุการณ์ เพื่อประเมินรายได้ หลายร้านอาจจะโดนถึงการเข้าไปดู Stock สินค้าว่ามีมากหรือไม่ รวมถึงจะสอบถามว่ามีการใช้บัญชีธนาคาไหนในการเดินบัญชี อาจจะมีการขอดูยอดเงินย้อนหลัง

ธุรกิจแบบออนไลน์ ปัจจุบันตั้งทีมล่อซื้อ ทำเหมือนเป็นลูกค้า จนถึงขอเลขบัญชีธนาคารและนำชื่อบุคคล ตามบัญชีธนาคารที่ส่งให้ไปเช็คกับฐานข้อมูลของทางกรมฯว่าที่ผ่านมามีการยื่นภาษีหรือไม่ และดูจากภาพแล้วขายหรือหรือไม่ แล้วจด vat หรือยัง ถ้าดูน่าสงสัยก็จะส่งให้สรรพากรพื้นที่ ตามทะเบียนบ้าน ส่งจดหมายเรียก มาพูดคุย ซักถาม และขอดูหลักฐานการเงิน โดยเฉพาะบัญชีธนาคารที่ใช้ในการรับเงินจากลูกค้า #นั้นละคะที่เรียกว่าประเมินรายได้ย้อนหลัง

สรุป ทำธุรกิจในรูปแบบของบุคคล จะถือเป็นรายได้เมื่อได้รับเงิน ถ้ามียอดรายได้เกิน 1.8 ล้านบาท ก็ต้องจด vat (กรณีขายสินค้าที่ไม่ได้รับยกเว้น) ตามปกติต้องแจ้งรายได้เมื่อยื่นภาษีกลางปี และปลายปี ถ้าไม่ยื่นภาษีเลย หรือยื่นต่ำไปจนน่าสงสัย ก็อย่าคิดว่าจะสบายใจ เพราะมีระบบการสุ่มตรวจสอบอยู่ และถ้าให้ดีขอให้แยกบัญชีธนาคารของกิจการ ออกจากบัญชีธนาคารของส่วนตัวจะดีที่สุด
