關於陳茂波案，其實我想講了很久。這是頂級無聊的事。陳茂波兩夫婦因為聽了女兒講有同學話有個領袖生作弊，於是不停寫電郵去學校投訴，然後再寄信給所有家長，意圖作出壓力，又話要通知傳媒，又話要向更高級的機構的投訴。另外，又有些電郵根據他所講的東西寄去哈佛作出投訴，但不知是不是他做，未有證據顯示他做的。但當中的字眼和他所講是一樣的，結果令他入不到哈佛，因而要打官司。
我講這種的obession，沒有證據之下為何可以這樣做呢？他是偏執地持續地去攻擊人，但自以為是正義。我可以告訴大家結果是別人已經受到嚴重的損失，入不到哈佛。其實雙方都傷亡慘重。我未曾見過打誹謗官司是由陪審團去判。即使打贏這場官司，雙方都要花費數以十萬的錢，其實原本的損失是不太大，但訟費就真的不得了。輸了那個真的不得了，還要付對方3/4，而贏那個也要花幾百萬。當然我不能預估這場官司的勝負，主要因為是誹謗是很難告得入的，但否認了之後還是要這樣講，最難malicious intent，是否蓄意去傷害對方。但這件案很難話是fair comment，不能以fair commemt作為抗辯理由。這是不能話因為你自己相信。Fair comment是怎樣呢？舉例，我話細mark變了gay，這不能是fair comment。但我覺得細mark是個壞人，那可以是fair comment，因為壞人是沒有objective standard。但我話細mark是gay就不可以，因為可以physical proof他不是gay的，於是那是factual 是錯的。如果是這樣，只能作出道歉，就不能話是fair commet。不過自從大班那件案之後，告人誹謗是非常難的。當然我心中是希望陳茂波夫婦遭難。
