#勝訴後的日本黑箱 🇯🇵
「勝訴，不代表我受的傷害能消失。」因打破社會禁忌、控訴新聞界的職場大前輩山口敬之性侵得逞，進而觸發「日本版 #MeToo」運動的日本記者——伊藤詩織——18日在東京地方法院外，高興卻又難過地高舉著「勝訴」的布告。儘管針對山口的刑事訴訟因證據不足而無法成案，但東京法院的民事庭仍認為「山口違反意願的性交行為」為真，並以此判處被告應支付330萬日圓的損害賠償。然而全案自此仍引發日本社會的巨大爭議，許多伊藤的聲援者依舊不滿「為何強姦事實確鑿，東京檢警仍舊裝死無視不予刑事起訴？」；但山口本人與一幫媒體圈的保守派名嘴，卻仍堅稱「司法太過媚俗」，「 #MeToo 什麼的真是莫名其妙！」
　　
伊藤詩織遭遇傷害的事件，發生在2015年4月3日，當年24歲的伊藤才剛從紐約大學新聞系畢業歸國、並在《路透社》的東京分社實習，並在一次機緣安排下，與49歲、時任《TBS電視台》駐華盛頓特派局長山口敬之應酬。當時的伊藤正考慮是否應徵TBS的記者職務，再加上又有美國經歷，因此才會與資歷豐富的老前輩山口，一同約在東京惠比壽一帶的壽司店共進晚餐。
　　
根據伊藤的說法，自己一直以來都有飲酒習慣、酒量也算是相當不錯；但在與山口的晚餐中，自己卻莫名其妙地在1個多小時內，陷入了「爛醉狀態」。等到她醒來後，已是翌日清晨，伊藤才發現失去意識的自己早已被山口帶進旅館性侵得逞。
　　
東京地方法院的紀錄表示，伊藤在2015年4月4日清晨離開旅館後，同日稍晚即到婦產科驗傷；但由於社會壓力與受創後不穩，自己才會先諮詢親友與專業法律意見後，於4月9日向警方報案「遭遇山口敬之強暴」。
　　
然而儘管出示驗傷紀錄，DNA證明山口敬之的涉案；事發過程的餐廳、計程車司機、旅館，也都作證「伊藤詩織當時確實已失去自主能力」。但最後在漫長的調查後，東京地檢署仍因「證據不足」判定不起訴。
　　
部份日本媒體懷疑，山口敬之在媒體圈內速喜吹噓自己與總理大臣安倍晉三的「私人交情」，在刑事訴訟階段，亦有報導稱基層檢調「收到來自長官的不能起訴壓力」。但相關說法，並無法查證。只知道深陷性侵醜聞的山口，後來在2016年辭去了TBS的職務，並於同年稍晚出版了關於安倍晉三的新書、自此繼續活躍於右翼保守派的媒體圈子裡，始終堅稱「當時是伊藤自己酒後亂性、勾引自己...之後又為了出名說謊『仙人跳』！」
　　
「我當時也喝得酩酊大醉，像你這麼迷人的女人半裸著來到我床上，結果我們就『那樣了』。」在2015年4月18日——也就是伊藤向警方報案後的第9天，山口敬之才發來了一封辯解的「道歉簡訊」——「我想我們彼此都該檢討一下自己吧。」
　　
然而明明是受害者，但因公開控訴前輩而遭到業界封殺的伊藤詩織，不僅無法再回到原本規劃的記者之路，甚至還被社會輿論惡意抹黑為「那個枕營業的魔女」。雖然相關真相與社會控訴，後來透過《紐約時報》的調查報導傳遍國際、進而震撼本國輿論而一度帶動起「日本版#MeToo運動」的覺醒；但就案件而論，加害者逍遙法外，受害者仍受傷害的事實並未改變，因此在刑事訴訟不起訴後，伊藤才會挺著壓力繼續對山口提出「民事訴訟」。
　　
根據東京地方法院的一審判決書，被告山口敬之雖然強調「兩人當時是乾柴烈火一時激情」，但綜論各種主客觀事證，法庭認為山口的證詞矛盾，在事發過程中山口不僅全程清醒、還作出了許多違反常理的供述（例如：地鐵站明明只要步行5分鐘，山口卻硬拉伊藤上了計程車，繞了完全不是回家方向的路），因此法庭認為「伊藤控訴證詞相對可信」、山口藉機非合意性交的事實明確，因此判山口必須向伊藤支付330萬日圓（新台幣90萬）的精神賠償金。
　　
到許多人的支持，我才能走到這一步。」在勝訴消息傳來後，如釋重負的伊藤才在東京法院外忍不住留下了激動的眼淚，「然而今天的判決雖令事件告一段落，但勝訴並不代表我所受的傷害就此消失。」
　　
與此同時，迴避出庭的山口敬之，18日下午也糾集了一幫保守派的文人好友，在東京高調召開了「不服判決記者會」。山口表示：「自己沒有做非法的事，不可能接受法院不合理的賠償決定！」同時強調律師已準備好上訴，「全案絕不會就此結束！」
　　
「曲學阿世（扭曲媚俗），無比邪惡啊——聽到山口兄一審結果後，忍不住想這樣說啊！」陪同山口出席記者會的右翼文藝評論家小川榮太郎，如此諷刺地表示。
　　
小川榮太郎與山口敬之相同，同時日本右翼評論者中，最具個人爭議與保守的代表之一。長期以來，小川就時常在媒體與報章雜誌上批評「女性主義、性別平等與LGBTQ權力都是些軟弱的假命題」，甚至充滿惡意地嘲諷：「不如也保護癡漢的人權吧？」
　　
「搭乘滿員電車時，受不了女性氣味而想動手去摸的人，就是深受『癡漢症候群』所苦的男子，這是會不斷再犯，是身體無法控制的腦部問題，這個社會難道不應該來保障他們觸摸的權利嗎？」在2018年9月的保守派周刊《新潮45》上，小川離譜地於專欄寫到。
　　
然而此系列的文章因為太過令人傻眼，發刊之後不僅遭致輿論猛轟；甚至連《新潮社》本家的其他出版單位，都忍不住在社群出言諷刺，一時「集團網內互打」的風波也引起日本社會的騷動。最終，更直接導致了新潮社總集團的道歉，《新潮45》也自此永久停刊。

由前港督Lord Patten of Barnes同前英國外交大臣Hon Sir Malcolm Rifkind發起嘅國際聯署聲明，一個星期內由廿幾個國家嘅201個議員，依家聯署議員人數去到50國家728個議會政界人士！最壯觀不外乎係日本，不過唔該留意下嗰啲小國，例如科索沃、阿爾巴尼亞、立陶宛、斯洛伐克、緬甸等等小國，哪怕佢地得一兩個代表支持，但係以前人地國家出現問題，自問大家何曾理會過？睇完新聞下一秒就已經「哦，邊度黎㗎？」，然後食買玩揾錢唔記得...依家人地反而出黎支持...喂！簽個名有政治代價㗎，唔係應份！（本人自己都覺得有些少羞恥）
