เพื่อนๆ ครับ ขอแนะนำเรื่องแนวทางการนำอาวุธปืนไปด้วยนะครับ
1.อาวุธปืนมีทะเบียนและเป็นของเราเอง ไม่มีใบอนุญาตพกพา สามารถพกพานำติดตัวไปได้ ดังนี้
- เป็นประกาศของ ก.มหาดไทย ซึ่งเป็นนายทะเบียนอาวุธปืนทั่วราชอณาจักรเมื่อปี พ.ศ.2519
1) ไปเก็บเงินจำนวนมากๆ เดินทางผ่านที่เปลี่ยว เช่นใน ตจว. (ประกาศ ก.มหาดไทย ยกตัวอย่าง(ขณะนั้นจำนวนเงิน 30,000 ขึ้นไป)
2) เอาอาวุธปืนติดตัวเดินทางโดยแยกปืนกับกระสุนปืนออกจากกัน เช่นเก็บปืนไว้ในเก๊ะภายในรถยนต์ ส่วนกระสุนปืนเก็บไว้ท้ายรถที่ไม่สามารถหยิบออกมาใช้ได้ทันที ตย.ปืนลูกโม่ เก็บไว้ในรถ กระสุนปืนไว้ท้ายรถ
3) เอาอาวุธปืนติดตัวเดินทางโดยแยกปืนกับซองกระสุนปืนออกจากกัน เช่นเก็บปืนไว้ในเก๊ะภายในรถยนต์ ส่วนซองกระสุนปืน(แม๊กกาซีน) เก็บไว้ท้ายรถที่ไม่สามารถหยิบออกมาใช้ได้ทันที ตย.เหมือนข้อ 2) แต่เป็นปืนออโตเมติกหรือกึ่งออโตเมติก
4) เอาทั้งปืน กระสุนปืนหรือซองปืน(แม๊กกาซีน) ใส่ไว้ในกระเป๋าเดินทางปิดล๊อคกระเป๋าแล้วเก็บไว้ท้ายรถ ในลักษณะที่ไม่พร้อมใช้ได้ในทันที
ตำรวจส่วนใหญ่ไม่รู้ว่ามีประกาศ ก.มหาดไทยนี้อยู่ พบเห็นก็จะจับดำเนินคดี พงส.ก็ไม่รู้ก็สั่งฟ้อง อัยการก็ไม่รู้หรือรู้ก็ไม่สั่งเพิ่มเติมเพราะเห็นว่า พงส.สั่งฟ้องมา ผตห.ก็ไม่รู้และไม่ได้ร้งขอความเป็นธรรม
และอัยการอาจพิจารณาว่า คดีเช่นนี้ ปรับและรอลงอาญามาตลอด ก็เลยสั่งฟ้องไป ไม่ยุ่งยากให้งานเสร็จๆไป
ถ้าปรากฎข้อเท็จจริงตามประกาศดังกล่าว พงส.สั่งไม่ฟ้องได้
ส่วนอาวุธปืนมีใบอนุญาตให้พกพา
1.พกพาในจังหวัด
2.พกพาทั่วราชอณาจักร
มีหลักเกณฑ์พกพานำติดตัวดังนี้
1) พกพาต้องมิดชิด ไม่เปิดเผย น่าหวาดเสียว
2) ห้ามพกพานำติดตัวเข้าไปในงานวัด งานเทศการสถานที่ที่จัดให้มีการชุมนุมนัสการ เข้าไปในสถานบริการหรืองานรื่นเริง
ครับ เรื่องพาอาวุธปืน มีทะเบียนหรือมีใบอนุญาตให้มีและใช้ มีใบอนุญาตให้พกพา สำคัญๆก็มีแค่นี้ครับ
